Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Kiln Fit mobile application, website, and related services (collectively, the "Service") operated by Fieldhouse Athletic LLC, a Wyoming limited liability company ("Company," "we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Account Registration

To use the Service, you must create an account by providing a valid email address and password. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Notifying us immediately at legal@kiln.fit if you suspect unauthorized access to your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of Service

Kiln Fit is an adaptive physical training application that generates individualized training programs. The Service uses a combination of deterministic programming logic and artificial intelligence (AI) / large language models (LLMs) to create and adapt training sessions based on information you provide, including your goals, training history, fitness level, available equipment, schedule, and physical limitations.

3.1 AI-Generated Content

Portions of your training sessions are generated by AI. Specifically:

• Training session design — exercise selection, sets, reps, rest periods, and session structure are generated by third-party AI models (currently OpenAI and Anthropic) based on your profile and our programming logic.
• Session modifications — when you request changes to a session, AI processes your request to produce a modified session.
• Goal interpretation — AI assists in translating your stated goals into structured training parameters.

AI-generated content is reviewed against validation rules before being presented to you, but it may contain errors, suboptimal recommendations, or exercises that are not appropriate for your individual circumstances. You are solely responsible for evaluating whether any exercise or training recommendation is safe and appropriate for you.

3.2 Not Medical Advice

You should consult a physician or qualified healthcare professional before beginning any exercise program, particularly if you:

• Have a history of heart disease, high blood pressure, or other cardiovascular conditions
• Have musculoskeletal injuries, chronic pain, or physical limitations
• Are pregnant or postpartum
• Have any medical condition that may be affected by physical activity
• Are taking medication that may affect your ability to exercise safely

If you experience pain, dizziness, shortness of breath, or any other concerning symptoms during exercise, stop immediately and seek medical attention.

3.3 Assumption of Risk

Physical exercise involves inherent risks of injury. By using the Service, you acknowledge and agree that:

• You are voluntarily participating in physical exercise activities
• You assume all risks associated with such activities, including but not limited to sprains, strains, fractures, and other musculoskeletal injuries
• AI-generated training recommendations may not account for all of your individual health circumstances, even if you have provided injury or limitation information through the app
• You are solely responsible for determining whether any exercise or training load is safe and appropriate for your body and fitness level
• You will not rely solely on the Service for decisions regarding your physical health or safety

3.4 Military and Tactical Users

The Service offers optional features for military and tactical personnel, including fitness test preparation and field training readiness programming. These features are provided for general fitness purposes only and do not constitute official military training guidance. The Service is not affiliated with, endorsed by, or connected to any branch of the United States Armed Forces or any government agency.

4. User Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the Service or its infrastructure
• Create multiple accounts or share account credentials
• Use automated scripts, bots, or scrapers to access the Service
• Misrepresent your identity or provide false information
• Attempt to access another user's data or account

5. User Content

You retain ownership of any content you submit to the Service, including goal descriptions, session modification requests, check-in data, and training logs ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and store your User Content solely for the purpose of providing and improving the Service.

We may send limited, non-identifying portions of your User Content to third-party AI providers (currently OpenAI and Anthropic) for the sole purpose of generating training content. See our Privacy Policy for details on what data is shared and how it is protected.

6. Intellectual Property

The Service, including its design, software, algorithms, training logic, exercise library, and all associated content, is the property of Fieldhouse Athletic LLC and is protected by copyright, trademark, and other intellectual property laws. "Kiln" and "Kiln Fit" are trademarks of Fieldhouse Athletic LLC.

You may not copy, modify, distribute, sell, or create derivative works based on the Service or its content without our prior written consent.

7. Subscriptions and Payment

The Service currently offers a free trial period. When paid subscriptions become available:

• Subscription terms and pricing will be displayed in the app before purchase
• Subscriptions will be billed through the platform on which you downloaded the app (Apple App Store or Google Play Store)
• Payment processing is handled entirely by Apple or Google — we do not collect, store, or process any payment card or financial information
• Subscription renewals, cancellations, and refund policies are governed by the applicable platform's terms (Apple Media Services Terms and Conditions or Google Play Terms of Service)
• You may cancel your subscription at any time through your device's subscription management settings

8. Termination

You may delete your account at any time. Upon account deletion, we will delete your personal data within 30 days in accordance with our Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately.

9. Disclaimer of Warranties

Without limiting the foregoing, we do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• AI-generated training content will be accurate, complete, safe, or appropriate for your individual circumstances
• The Service will meet your specific fitness goals or expectations
• Defects in the Service will be corrected

10. Limitation of Liability

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Fieldhouse Athletic LLC, its owner, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any injury to yourself or others resulting from exercises or training performed in connection with the Service

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law provisions.

12.2 Informal Resolution

Before filing any formal legal proceeding, you agree to first contact us at legal@kiln.fit and attempt to resolve the dispute informally for at least thirty (30) days.

12.3 Arbitration

Any dispute that cannot be resolved informally shall be resolved by binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Casper, Wyoming, or at a mutually agreed location. The arbitrator's decision shall be final and binding.

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fieldhouse Athletic LLC regarding the Service and supersede any prior agreements.
